Clash between planning and building regs?

Hello again

Another point that has come up with the same windows as the other thread I have going.
On the road facing windows planning have said that we cannot fit large opening windows only fanlights as are already there.

But for building regs/Fensa I will need to add some fire egress openers as these are flats and several of them don't currently comply with fire escape routes.

I had already spoke to building control about these windows before the letter from planning. The windows would open directly over the pavement at head/chest height. Building control agreed I could add fire egress windows with non locking restrictors.

I would assume building regs/safety should come first here and over rule the planning people?

Window replacement should be no worse, not better.

Planning takes precedence - ie you don't have to change the windows.
