Advice on bedroom being given to adjoining house

please can anyone help or give any information that may help, we have bought a house from the council around 10 years ago, it is a semi detached property and it was my partners family who moved in around 35 years ago. The house next door was given one of the bedrooms and our house is now a 2 bedroom property rather than 3, this was done around 40 to 50 years ago, both properties have now been bought from the local council, however if we ever try to sell our property we will find it difficult because of this situation. Is there anything that we can do about this? Thank you

It sounds like the people next door have a "flying lease" of the bedroom that was previously part of your house. Flying leases are not un-common and provided there was some sort of lease arrangement created and documented when the bedroom was transfered then there will ( should ) be no legal problems when you sell. However some buyers may be put off by a neighbours bedroom being above one of the rooms in the house they are buying from you.

( one of my bedrooms is over the adjacent retail unit which was once part of this cottage )
 
If it wasn't a problem 10 years ago when you purchased, and your conveyancer did all the legal work, then it wont be a problem when you come to sell.

And I can't understand why its an issue for you now either.

But its a stupid arrangement regardless. And I would wonder if all the compartmentation work was actually done, or done properly.
 
whilst there shouldn't be any legal issues, you are correct there could be issues. as pointed out from a point of view of desirability, but also potential buyers may be limited as to lenders if they need a mortgage as some won't lend on flying freeholds.
But not a lot that can be done now, unless you approach your neighbour with a view to buying it back and converting it back into your dwelling, which would be subject to current building regs.

Thanks for the replies, we are thinking of approaching our neighbour to see if they would be interested to sell it back to us, I was just unsure if this was legal surely the council should have had to restore the properties to their former state before selling them on. It's all very complicated.
 
it may cost you around 30% -50% off the house cost to buy back the room
have a look on zoopla for 2/3/4 bed costs in your road
