Liability for burst expansion vessel

If the expansion vessel capacity was less than the system expansion the consequences would have been that system pressure would have been lost through the PRV (safety valve) requiring continual topping up. The answer to this problem would have been to install an additional expansion vessel. The customer might not have been happy about having to pay for this to be done and might argue that this should have been explained to him before the work was carried out, but there is such a thing as being reasonable.

There is also such a thing as wear & tear and this is the category that this failed expansion vessel falls in to. It is bad enough having to guarantee most of the poor quality materials that we are forced to use for 12 months, but if a tradesman had to guarantee existing materials against failure it wouldn't be worth him getting out bed in the mornings.

I suspect that British Gas would have reached a different conclusion if they were the ones being held responsible and I don't think your customer would have tried it on with them anyway. Don't pay him a penny and make sure your invoice to him is sufficient to cover the additional costs that you have incurred through no fault of your own.

BG carry out a safety check that requires all tests ie burner pressure, safety devices, fluing ,ventilation, CO emissions, visual checks of the heat exchanger and conbustion chamber. If any of these are not correct then a full strip down service is carried out to rectify any problems. Also a full check of the system is carried out.

The BG contract states that any third party involvement such as a customers own contractor, are responsible for their own work they have carried out, regardless of what the problem was. BG will not repair any one elses cockups. If such a thing happened while BG engineer was working on the system then they would repair it on the terms of the contract. Very simple, cars are serviced and MOT's are carried out but they still break down, many soon after.
