It is a party wall although the party wall act is irrelevant once building work has been completed anyway, whether the wall is strong enough or not is also irrelevant, I'd think its trespass or criminal damage or something try here: http://www.gardenlaw.co.uk/phpBB2/index.php before you get solicitors involved.
