NHBC - Sound insulating

Hello

We moved into our flat 4 years ago and at the time the flat was 4 years old. The flat next door was owned by a man who worked away and when he was home you could never tell he was in. He has recently left and a family has moved in. It is clear that one of the walls separating the flats has very poor sound insulating. No complaints about the family, the noises are natural (baby crying).

So the the flats are 8 years its it possible that we are covered by the nhbc warranty?

No, whilst NHBC warranty's last 10 years they're no good for things like this only for structural problems or other serious defects. There's a £1000 excess too so that prevents most claims in their tracks.
 
The regs for sound are a minimum requirement and pretty poor to be honest. No developer is gonna bother exceeding the bare minimum requirements due to the additional costs involved.
So your properties may well meet existing requirements.

There's a prettty good chance the building was built under the Robust Details rather than pre completion testing. That being the case there is no minimum standard - it just needs to have been built in accordance with the details. I know of a house builder that switched to testing because of the excessive cost of RDs. Although they still used the RD as a build standard they were surprised at how many failures they got.
