cutting down a small tree

i would like to cut down a small tree which is taking up space on my driveway, removing it would mean i could get both cars on the drive. i do know that there is no TPO on the tree (its only a small tree about 9 foot tall, not anything special) on my deeds it says i should not remove trees unless dead, and in that case i should plant a new one. am i allowed to cut it down if i plant one to the rear of my house instead? as im the only house on my side with a tree, and there is evidence of other houses with stumps...so obviosuly they have cut down. its just with my luck i can see my getting in trouble

Ignore the deeds and cut the tree down.
