A Hampshire landlord's failure to have a gas system adequately serviced and maintained led to the tragic death by carbon monoxide poisoning of the 11-year old daughter of parents occupying the rented property. The girl was one of the roughly 20-30 people who die from carbon monoxide poisoning associated with domestic gas appliances, more than half of these deaths would probably have been avoided if the appliance had been serviced by a competent installer in the previous year.
The landlord was prosecuted and pleaded guilty at Andover Magistrates' Court to failing to ensure that the boiler was maintained in a safe condition (contrary to r.36(2)(a) of the Gas Safety (Installation and Use) Regulations 1998) and also to 3 charges of not having gas safety checks completed within 12 month intervals (contrary to r.36(3). At Winchester Crown Court he was fined a total of £42,000, with costs of £18,000.The incident occurred during March 2003 at the property in Southsea, the gas boiler, which was found to be in a poor condition, had not been serviced since 1996 and, although subjected to a number of gas safety checks during the time the house had been let to tenants, these checks had not been carried out within the required 12-month intervals.
