If the trap's leaking and the plug doesn't work, I'd suggest taking it all off and starting again. Sounds like the cable isn't working properly or something isn't put together right.
 
You take the silver cover off the plug hole, then untwist the outer part of the plughole. There is a special tool you can use, but I managed to undo mine by hand (although it was a bugger)!

managed to get it of with a big chisel, it was the right size to unscrew it, All the rubber silicone is knackered though.
 
right then I've taken everything off and all the silicone knackered. You reckon new sealant and some plumbers mait?
 
I just squirted some silicone around the plug hole in the bath before reinstalling the mechanism.
However, if it wasn't working when installed, I'd make sure it's working before you put it back onto the bath.
No Plumbers mait required.
 
should there be a rubber ring for the plug. Not the 2 big ones that already fit underneath, and the bit that the hinge fits into has holes all the way through, is that normal?
 
its ok. no rubber ring. the mech works fine but it doesn't seem to take the plug all the way down? You know the silver lid, that covers the plughole, its on a hinge, where the high fits are 2 holes that go all the way through the plughole ring? if that makes sense?
 
Ok sorted the leak but the plug won't go in all the way its asif the whole mechanism is slightly off?
 
yep the bottom bit where the plug goes into isn't central so need to sort that

the leak was coming from the bath. all the sealant was knackered.

I sorted the waste thing with a flex coupler from b&q . its a grey rubber thing and fits from 38mm to 50 mm. it has an adjustable ring at each end that you tighten with a screwdriver.

Personaly if you get one of these I would unscrew the plug and remove the rubbers from underneath then reseal them and before you fit it check that the plug sinks all the way down.

I'll let you know how i get on with a replacement.

I will post this on both topics for anyone else who gets 1 of these.

firstly thanks to everyone who gave advice.

right then down to the nitty gritty. the instructions actually give you 2 choices. use a 50mm or a 40mm However the 40mm isnt 40mm so your off to a carp start straight away. Its a 1.5 inch so 38.1mm. when you order your bath and waste you also need a macalpine t28 http://www.mcalpineplumbing.com/1-189-multifit-straight-connector.html

And no it doesn't tell you any of this in the instructions.

once you have fitted the legs and waste to the bath see if the plug drops, if it doesn't then it will be off centre just like mine is (ideal are sending someone out)

before you attempt to fit the bath pour some water in it and check for leaks. I am not the first person who has had either no seals or inadequate seals.

if it leaks then you will have to take it apart and seal it yourself.
there is a special tool to unscrew the plug hole side but i used one of these

yes I did feel like smashing it to bits but i used it to unscrew it instead. it fits really well.
