Am I going to be sued ?

Obviously don't want to get involved in a slanging match here but can I just reply to Joe 90.
You say you gave me good advice at the start and I chose to ignore it....your very first piece of advice was '' Just ignore anything she posts. She paid. End of story ''
I can assure you Joe taking this advice and ignoring her letters would probably be the WORST advice anyone could ever have given. My advice to you if ever you get into such a predicament would be to deal with it as you see fit but please don't take your own advice by ignoring letters !!
At what point as a matter of interest WOULD you start replying to letters ?? Her second one ?? The first one from her lawyers ?? The second one from her lawyers ?? The first one from the courts ??
As I said I weighed up all the advice given, some was good, some I know was utterly and in some cases completely wrong, but everyone had an opinion. I did what I did in the end and as securespark says he would have paid her off at the start just to get rid. thanks anyway.

Bang on-- Ignoring letters only delays the inevitable .
Anyone who 'has not been there'--will never know what it feels like .

So whats the worst outcome if you ignore the letters?

Is the judge going to issue a bench warrant for the arrest of a painter and decorator because someone is claiming his work is not up to scratch?

You need to grow some balls in these situations and call their bluff. If you are arrested just apologise and say you were working away from home and didn't receive the letters.
Maybe they got lost in the post. It happens all the time.

Her side wanted £2800 all told. The outcome was i settled out of court and payed £800.

You only did £900 quids of work in her home ffs. Now you've paid back £800 quid!

Did you do £800 quids worth of dodgy work and damage in her home?
Yes or No?

If the answer is "no" then you should have put your case before the judge.

Do you think a judge is going to look at a job costing £900 quid and then make you stump up £800 because they are claiming the work is dodgy?
If you think the answer to that is "yes" then you really are a cowboy.

What do you think a judge is going to make of a woman claiming £2800 back for £900 quids worth of work?
There's a name for people like that where I come from. I'll give you a clue. It begins with "C".

Norcon and Joe90,
Joe, I did a decent job and wont go over everything again but made a judgement call and agreed to cough up the £900...maybe you would not have. You say in your last comment 'as the photos and expert witnesses can testify ' If you had been her lawyer and said that to me in court I would have said ' and Mr Joe 90 who are these expert witnesses to which you refer ?' You see Joe at no point have I said she had expert witnesses so if you ever end up in court DONT make mistakes like that...you'll get slaughtered by the claimants solicitors.
Norcon you say ' what's the worst outcome if you ignore the letters ?' and 'You need to grow some balls in these situations and call their bluff,' Honestly mate I've been through it all and have gained a mass of experience in the process....without seeming like a cocky so and so if I wont even answer your question as to ignoring the letters and the eventual outcome...browse the net and see what would happen to you if you took your own advice.

Well who made the list of 700 odd faults then?

Heartsdrainage...you're right but get the impression Norcon was suggesting ignoring letters...period, not good advice I think you'll agree.
Joe Joe Joe...... ' Your Honour Mr 90 has made two recent comments the first regarding 'expert witnesses' and the second 'who made the list of 700 faults then ?' There has been no mention, your Honour of expert witnesses and no mention, anywhere of 700 odd faults. I suggest your Honour that Mr 90 has not read the facts in this case, which shows a lack of respect for my client and to yourself and the Court your Honour and would suggest on this occasion that in view of Mr 90's lack of respect and failure to grasp the facts put forward in the POC's the case I think you will agree should be dismissed forewith'
' Quite right mkb' case dismissed'
Sorry Joe...just a bit of fun mate...but not so easy is it ?

I think you should read your own thread. You did £900 worth of work and you AGREED that £800 of it was sh*t.

I rest my case.

I have followed this post it has been interesting and I initially had sympathy with the poster, but somethings not quite right, how did the customer up the original cost to £2800 for Court Proceedings
If the job cost £900 why pay the customer back £ 800 it dosent make sense.

bosswhite, Long thread I know, but basically the job was done for £800 exc. paper..the final figure £2800 was the original cost of the job, paper, court expenses etc., and the final £900 was what was eventually agreed, through mediation to stop the case before a full hearing.
Joe a payment through mediation is not an admission of guilt. Nor does it mean that the claimant was admitting SHE was wrong by only accepting £900 when she was claiming in the court papers £2800. That's the way the process works. Someone once said that 'the law is an ass' With this experience, although I didn't reach the final fence, I tend to agree.
You do rock the boat on some of these threads Joe, I think it's a bit tongue in cheek....
Quick one Norcon..again something I've learned as a result of all this...You CANT say you didn't get the letters...ask a lawyer about when such letters are 'deemed as being served'

£ 2800! The original cost of the job to wallpaper one fookin wall?

I'd have skimmed, then Gardz, then papered for £400. Absolute perfect job - not a blemish - and I'd guarantee it too.

Joe....This is better than the TV any...WHAT on earth are you talking about ...one fookin wall ? Are you joking or are you genuinely mixing about 15 different posts up ? Go to bed with your laptop and start at the beginning..read all the posts...get the facts together....and correct and THEN comment.....I'll have a glass of whatever you're on mate.
