Human rights strikes again.

But surely photographs can serve to reinforce the memory of the abuse, by the abuser?? This is why serial abusers/killers often keep "mementoes" of their crimes. (do some research at least Boss) ;) ;) ;)

Nah, the police have done the right thing in my mind... If anything, it's the law that's now failing the victim. (as it so bloody often does)

I agree. Having seen some of the 'sentences' passed these days, I've come to the conclusion that the law is now there to protect the poor misunderstood criminal.

Under other circumstances I would agree, the victim does not want to be reminded of their ordeal.
But the perpertrator was a Family Member and I am sure within the Family circle there are going to be a lot more reminders to the victim than a few snap shots on a lap top.
Will the Police confiscate everything that could be a reminder ?

As distasteful as it is to have the victim thinking that he has photos of her, the police must follow the law, they do not 'decide' what is appropriate, that is a matter for us the public, and the courts.

Them going ahead and deleting them is virtually guaranteeing a civil compensation claim against them from the convict, and that goes against their duty of care towards our public funds.

Blimey, caja, I'm impressed. We've had our differences but that post of yours had a much further sighted view than I've seen you express before.

Your comment about the police following the law, is most appropriate. Especially when several other posters are suggesting that the police should "do as they think fit", which is a dangerous direction and a dangerous precedence. When will they next "follow their instinct" instead of the law?

Bearing in mind the other posters have been suggesting that this data is data that the criminal should not have. What other data will they deny the criminals next, against the word, principle and letter of the law?

The only correct action for the police, is to seek court action for the data to be destroyed. But this will hardly prevent the criminal fom obtaining similar data, on his release.

This is not any kind of support for the criminal or denying the victim the proper respect. It is upholding the fundamental rule of law.

Which is, quite often, AN ASS!

I have a BIG problem when it comes to 'might over right'. (No matter how democratic).

It assumes that the majority who vote make the right decision or know what they're voting for.

But since we don't have a better system. ....?

I agree, but where does one draw a line over who should have family photographs
Its something that has made news headlines and there is no real answer .

It's easy. If it was my kid, then I (plus his mum) draw the line. I'm reasonable, I wouldn't dictate what photos another reasonable person could have, especially a family member. But my kid is legally my responsibility and I decide. End of.

Come on, BT, surely if it was a real deal, then it should be debated and decided in Parliament, and we'd (well not me, but you know what I mean, although I suppose I could write to an MP, despite not being on the "roll") all have the opportunity to make our views felt.
Additionally, the MP are often parents, etc, and have the same sense of justice as us.
That way, (and don't forget there's about five years in which to act or enact) something lawful could be done by the police.

OOOps, sorry I didn't mean it to come out like that. (something lawful....by the police.)

One cannot help but wonder why the convicted paedophile actually wants these pictures  One may wish to query his motives and as such reconsider the length of his custodial sentence, especially when his request for parole comes up before the panel!

One cannot help but hope that by "shooting" himself in the sheet and handkerchief, he has in fact shot himself in the foot!!!

If he's really wierd, he might put his foot in his mouth when he opens it.

Gawd, I can't believe I typed that.
I think it's time I signed off....for good that is, not just tonight.

When you get as bad as the inmates, it's time to call it a day. ;)
I suppose I could do a "Dr Who" if I really felt the need.
