How close to ground level with full trench fill?

Have 1000mm deep trench excavated in prep for full fill of concrete. The groundworker is of the opinion the fill must stop 100mm below ground level at the highest - however, I used this method once before and filled right up to ground level, the bco didn't complain. Has something changed in the regs or is the groundworkers knowledge lacking?

I would like to fill up to ground level because it finishes bang on with a mortar joint on the existing structure.

You can fill up to where you like, it is normal to keep it bellow ground level to allow soil,grass or slabs etc to cover it.

...as I thought, cheers for confirming.

Due to the nature of the site (sloping) and a relatively high dpc on the existing structure, any foundation concrete will be covered in later stages of the project by slabs for a patio / path etc
