Just after a bit of info, I am a self employed plumber if I was to hire a self employed labourer would I need to pay 20% of bill into CIS or could he invoice me and I pay him in full and he does his books at end of tax year?

Legally you need to register as an employer and deduct 20% via CIS etc. etc.

Have you looked at the employment status criteria regarding self employed v's employed? Newboy is correct in highlighting what constitutes an employee.

People are considered self employed if....

they’re in business for themselves, are responsible for the success or failure of their business and can make a loss or a profit
they can decide what work they do and when, where or how to do it
they can hire someone else to do the work
they’re responsible for fixing any unsatisfactory work in their own time
their employer agrees a fixed price for their work - it doesn’t depend on how long the job takes to finish
they use their own money to buy business assets, cover running costs, and provide tools and equipment for their work
they can work for more than one client

Easiest way if it's a one off is for the customer to pay the labourer direct. Otherwise you'll need to register them up for CIS and even if you don't use them you'll have to do a monthly return.
