Fences - attaching things to existing fences

Hi all,

If I have a fence and a neighbour screws things into it without my consent; are they liable if it then causes the fence to fall and/or damages the structure of the fence in any way?

Similarly, if I've modified a neighbours fence (with their consent and approval) am I then expected to maintain this in case of damage?

Fences are the bane of my life...

If it is your fence and you paid for it, then it is your property and no one should touch it without your consent, you could ask for repair money, but not sure where in legal terms you will stand, but it is damage to your propoerty...

As for ongoing costs to maintain something on someone elses fence, i would do what seems reasonable. if it is only there to benifit you, then you should pay to maintain that benefit.

if its just small hanging baskets or smaller fixed to the posts it should do no real damage
what exactly is fixed to the fence and what sort off fence is it ??
does the fixed item seem to make the fence move where it didnt before??

Thanks for the feedback - we shall see with regards to if the fence can handle the additional weight, I just was curious as it was an 'improvement' that was undertaken without consulting the owner of the fence!

As for the other fence; it benefits both of us (previously a chain link fence, the addition provides some privacy!) I guess I'll take a look, see what needs to be done and the cost and then speak with the neighbours to see if they'd be willing to chip in at all (even labour assistance would count!)

people often don't realise a fence has an owner the just assume its a fence and there side is theres to do as they please with
where as they are not even allowed to paint or touch the fence
off course the neigbourly thing to do is allow any reasonable treatment off the fence that will not cause harm or damage
