No it isn't. The OP clearly stated that the builder told them they did not need Building Regulations approval as the extension was replacing an existing smaller structure. If the builder took it upon himself to give advice on Building Regulations he takes on that duty of care.
No, he is not a professional in that capacity, so what he gave was an opinion. It's a massive difference between opinion and knowledge, and there is no duty of care or negligence attached to opinion.

I would disagree, a builder would have had to deal with this regularly and if not then they should have said they are not sure and to get advice from building control.

If you were to as a spark or chippy about building regulations they should know what relates their work.
 
I think we are in danger of losing sight of the important facts here. It appears that the OP has been let down by a dodgy builder. Now we can either offer some constructive advice or we can blame the OP for being "thick" and not knowing about the building regulations whilst having a pedantic discussion about the builder's duty of care and whether the Council would serve a Section 35 Notice or a Section 36 Notice.

It is normal for foundations to be discussed on site with building control when a trial hole has been dug.
If you read my post correctly, you will see that it was the building control inspector that said I had to stop building works.

The architect did the plans and submitted them for approval and they were passed. He didn’t do any of the building regs/control stuff. He had to do and submit them.

The plans said footings 1m deep so that’s what we dug - and discovered the land drain.

I deal with lots of builders, and they are large and small and good and bad and knowledgeable and less so, but the one common thing is that they invariably don't know the in's and outs of planning and building regulations, party wall act, build-overs, covenants, access and any other applicable law etc.

They only know what they have been told by someone or other, and don't know how things apply to specific circumstances, and builders don't stay up to date with regulation changes - because they don't need to as they are builders. They build to someone else's guidance and specifications, and that someone else is the one who needs to know the laws.
 
Jesus Woody sometimes you are hard work. For duty of care read "responsibility". Sorry OP I think you are wasting your time here.

Just for info my daughter who lives with us is about to have a baby and we wanted him to finish the kitchen first so we didn't have live in the sh** with a young baby He then went into violent abuse of me and my wife and calling me a cu** and acted in a threatening manner which I have on CCTV and as I am disabled with one leg and we are pensioners we didn't fight back although 20 years ago he would not have got away with that. As we are trying to sort the mess out we have a list of 45 things not finished or completed badly the latest of which was the fact he seems to have built the footings on lintels and we only noticed that when we moved a pile of rubble which he didn't even bother to move and rendered down to the rubble as you can see in the picture To be honest I didn't come on here to be told not to blame the builder I thought I was getting advice not defending the world of builders. This is the type of builder you are defending !! My wife and I are frantically trying to finish the kitchen as my grandson is due to be born in 8 days So I am not coming on here to have people defending arseholes like this builder. There are some comments that are helpful but others suggesting I am thick and stupid and yes I feel stupid about this and don't need to be told so by the people who think the builder is an innocent party in this. He has nearly all the money for the work as he demanded money quite regularly so we have treated him and his workers more than fairly umpteen coffees a day food and I even gave one of his workers a wood burner we had as he needed one So quite honestly I have toatally had it with builders and will endeavour to finish the work myself as we cant afford to get someone in to finish all the work Thankyou to the people who have made constructive comments Goodbye
 
Whether the work is good or bad is nowt to do with the customers' responsibility regards controlled work.
The work could be top notch and fail Building Regulations. The work could be poor quality and pass Building Regulations.
It's a shame if you have had poor quality work done and your builder needs to sort it out. Those with experience are merely pointing out to those with none about the responsibility of the client (homeowner) regards controlled work. Sorry to you folk that don't like it and would love to blame the builder for everything, but you will be disappointed regards this aspect.

As for shoddy work - you are obliged to allow the builder to rectify, first and foremost.

Ho jock194 Im sorry to hear of your trouble -sounds like you have been involved with a nasty piece of work.

try not to be disheartened by this thread -this forum has some highly knowledgeable posters, so if you want further technical advice to help resolve the problems on your extension, this forum would be a good place to start.

Agreed, I don’t believe any of this thread was intended as an attack on you, maybe appeared a bit unsympathetic at times but you sparked a wider debate on an issue people on both sides of the argument feel pretty strongly about. if you take the emotion out there is a lot of knowledgeable advice which can only help you in the long term. Sorry to hear of your situation and hope you get it resolved.
