Building Inspector Company No Longer in Business. What now?

Apparently this is due to the legal exposure inspectors face post-Grenfell. A lot can no longer get PI insurance. In the OPs case the partially inspected work should transfer back to the local authority and fees be refunded. They haven't gone bust (have they?), they have chosen not to continue to provide this service. The LA inspector needs to pick up from the last point, however you should familiarise yourself with this:

Without understanding the detail, my fear is that signing the cancellation notice gets them out of their contract and limits your claim for damages.

if the project has been transferred back and you are a consumer then I would explore issuing a claim for damages - this is in the small claim limit and might not be worth them fighting. As you say its not you terminating, its them.

I'm in Bedfordshire and in the same boat, same company too. My local authority have said they will not have to carry out all the inspections if previous reports can be forwarded, trouble is Aedis are not replying to calls or responding to emails. The fee is a worry but starting from scratch on inspections on a near fully built extension and renovation are possibly more of a worry is any dismantling is required or if the local authority fail something that Aedis passed...
 
Shouldn't think the local authority bldg. control will fail something Aedis previously passed.

But it could be a bit like getting an MoT for a car; take it to three garages and it will probably be failed on three different items (unless it's mine whereby it would probably be sent for scrap on sight)

Don't encourage people or they will be going to 4 different architects and 10 different builders for quotations :D
 
I went to an exhibition and a local council was there offering building control. I was confused, but they told me they offer the same service as private building control, so they were at the exhibition drumming up business.

May be a different council, may be more sympathetic?
 
I once went to an exhibition provided by the local council building control and they were providing free cream cakes.:giggle::LOL::D

Yes, some LABC tout for business in other areas.

Dont know about the cream cakes :ROFLMAO:
 
Worrying to read this . I checked and I am with Butler and Young. The insurance runs out today. Did not get much reassurance from them and I paid up front. Any one else with them?
 
For anyone in the same boat. I got an email from Aedis liquidator saying that Aedis has gone bust so I am not likely to get any refund of my fees.

Local authorities also said I need to sign the cancellation form as otherwise they are not allowed to visit the site.

After more than 2 months the LABC also contacted me to say that the now have got whatever they need from Aedis so I just need to pay the LABC.

In their letter, they said an assessor has attended my site and my fee is £xxx. I told them nobody had visited my site. After a bit of back and fro, LABC apologises and said it was a standard letter that they sent out but the fee is correct as they felt that it was faster that way rather than get an assessor out first.

Essentially, the conversation went ‘give me the money first before we talk further’


Yes my biggest concern is the dismantling part for inspection. We shall see what happens from here.
