Plaster fell off ceiling when painting

I had my whole house reskimmed. I wasn’t happy with the quality of the finish, lots of blemishes and two previously blown plasterboards were skimmed over rather than replaced but I paid the plasterers in full but made sure they knew how I felt.
Two weeks later my decorator started to paint the newly plastered walls. In one bedroom the plaster came off when she painted the walls, she patched this for me with filler. In one bedroom the plaster came off on the ceiling and she patched the best she could as more and more plaster kept coming off. I have during this time been in contact with the plasterer, sent him pictures and requested a partial refund and heard nothing from him.
Today the decorator was working on the kitchen ceiling when the whole lot came down on top of her.
Obviously unable to patch this I contacted the plasterer and sent him pictures. He finally responded but stated that it is the paint falling off not the plaster because the decorator did not mist the ceiling first. The pieces that have fallen are about 3mm thick (not paint!)
Who is right, do I have a claim against the plasterer?

You need to send him these latest pictures because the first set does look the skim is still on the ceiling with thick paint sheeting off it,well to me anyway

Thanks, but even with the updated pictures he is denying it is the plaster.
