Hi guys can anyone on here give me some advice me and my gf are looking to buy the house that has came up for sale over the road from us since the current occupiers have moved out and put it up for sale the next door neighbour has pulled down the dividing hedge that splits the property and erected a 6ft fence 1 ft over onto the property for sales land... can anyone advise what we can do about this can we speak with the estate agent while viewing which we have booked in tomorrow

Point out the issue to the estate agent and state that you won't buy the property until the issue isn't resolved by the seller. Once the estate agent is aware of the issue they can't pretend they don't know

Are you sure they have pinched a foot?
Might you be thinking the centre of the hedge was the boundary rather than it was all on their side?

The best time to do things unfortunately is before new people move in as when they come to view it looks the norm.
Contacting the estate agent probably won’t do much they will simply find another buyer who wouldn’t know. You would be better contacting the current home owner if you know them.

Very very wise comment and v good advice....do people listen? Generally not.Then they buy the house...have a 20year court case.ignore the neighbours.have 20 years of hell..bankrupt ...THEN they learn.Blinded by the money.

Accurate to 300mm?
I know somebody who had a neighbour move a fence whilst they were on holiday.
legal action went on for a few years, cost over £50k got nowhere.
then the neighbour moved.

Depends by how much the fence was out, but I would say either the deeds were not clear or the solicitor was carp!
I believe this sort of thing is most common when a house is left empty after the owner has died.
There will be Streetview photographs, and often the council keeps old aerial photos (for tracking unapproved developments). Sometimes the plans are accurate and to scale.
I once had to swear to the boundaries of a house that I had known since childhood, when a solicitor lost the deeds (it was nor Registered).
