If you report, company's will put it down as 50/50. But both will see it as a claim and both premiums will go up

60/40 liability to the oncoming car.

The dash cam vehicle was slightly ahead and at the point of impact was not overtaking a parked car. As others have said oncoming vehicle crossed the centre line. Dashcam vehicle should have moved over more, but was not obliged to.

I reckon insurance will collect excess from both and load both premiums. note both still have to declare even if they say zero value claim.

Of course he was. It would have avoided the collision.

Were there more parked cars similarly spaced on the dashcam car's left and none on the right, he is not entitled to drive the whole length of the road in a straight line.

No wonder there are so many 'accidents'.

How far apart do cars A and B have to be before D (dashcam) is obliged to move to the left or conversely how close do A and B have to be so that D is not obliged to?
 
Thats why both have some liability. Both drivers could have taken steps to avoid the crash.

It's not a case of who, exactly, legally, morally & in the court of public opinion, is to blame (50/50 IMO) but "where to go next"?

Id say the dashcam car driver had his eye on car B so was positioning himself to smoothly pass and misjudged how close he was to the centre, or assumed the oncoming car would pass the parked cars more tightly.

Or the dashcam driver was warching the girl with the short skirt out of shot.......

D is required to take reasonable steps to avoid an accident.
Other is required to not cross the centre line unless it is safe to do so.

rule 167 DO NOT overtake where you might come into conflict with other road users.

D was not overtaking at the point of impact.
 
I would say oncoming vehicle was more at fault, 60/40. I would think insurers would settle knock for knock though, therefore the correct answer to the OPs question is... "the person insisting it goes through insurance is a moron".
 
Driver with dash cam had no reason to be centre of road as they have clear road , but oncoming driver also had no reason to be in centre of road as there was plenty of room to both pass, so 50/50 . Both poor drivers .

Concur. Appalling driving on both counts. The odds of an accident occurring when you have two crap drivers on the same stretch of tarmac, increase exponentially.
