I wonder whether someone can help me. I refer to a recent article in the Daily Mail. It was entitled, "Former owners of £1m barn conversion are told to pay £300,000 after failing to tell prospective buyer couple that a Motel and Diner would be built next door". The DM link is at:

Also from an article in The Times it seems that this case was heard during February 2020 at the Central London County Court and probably headed Powell v Ash.

I was intrigued by this case as there are issues that could help me greatly. But my attempts to find any reference to it have failed. It appears that the case was heard at county court level and not on the main database of rulings.

Is it possible that someone could find and send me a link to download the detailed ruling by Judge Simon Monty QC.

Many thanks

You have to pay the court for the transcript. If it was a higher court it would be public, but it’s not a binding ruling outside of the particular case.

Isn’t that what we pay a solicitor's search for? Surely it’s the solicitor that should be having to pay their client?

Judge Simon Monty QC said the Ashes had incorrectly answered questions on the sellers' questionnaire relating to whether they knew of any development plans that would affect the property, known as Lake Barn

solicitor had done their job.

solicitor had done their job.
Thought they had to be a bit more diligent than asking the vendor - aren’t they supposed to check for planning applications etc - sometimes the vendor may not even be aware?

It may not have come up on a search. Besides, they are optional.

Thanks everyone and in particular bernardgreen who suggested contacting someone who appeared for the claimants in the case.
