Scaffolders insurance

I hired a scaffolder to put some up so I could point my chimney stack.
He put it up while I was out and I discovered he put in only one platform and it's too high for me to reach with my 25ft ladder.
When I rang him to ask him to put up a ladder or a lower platform with access, he said "why do you need to get up there mate?"
When I told him so I could point my chimney he said I wasn't allowed to go up there, his insurance only allows businesses to use it.
Can this be true? I've hired scaffolding I'm not allowed to use??

No. Tell him to bring a ladder, if he asks for what business tell him "Mind Your Own Ltd".

Has he given you a NASC handover certificate? That will detail the use it was designed for, and it makes no difference who uses it as that's nothing to do with the scaffolder, as once handed over its your responsibility.
 
Thanks, I haven't seen a NASC. But when I ask him for it I suspect he will raise the point of me originally offering to pay in cash, ahem.
Maybe I'm to blame as much as him. On the one hand he didn't ask me if I was a business. On the other hand I didn't tell him what height to provide access from. (having had scaffolding before I kinda assumed it would begin a bit lower than 30 ft)

It does not matter. All you need to do is tell the scaffolder what you need the scaffold for (ie what work is to be done) and he should then design the scaffold for that work, including access. That's it. It matters not if cash or card, the NASC rules apply.

His obligation is the erect it safety, and ensure it is safe for it's stated purpose at handover and that's it. He hands it over to the customer in a safe condition and that's the end of his obligation (unless its been negligently erected).

Oh goody. He refused to create a lower platform with a ladder up to the higher platform because he's "not allowed to leave ladders on it".
When I said I could hire an extra long ladder and suggested he absorb the cost he had a hissy fit and said he'd take the lot down. I shall have to wait and see if he does. Maybe he'll cool off first.
