I wouldn't spend more money on more surveys.

Personally, I think you have given him a chance to correct, and had a specialist (new roofer) say it is carp - presumably he will write this down. I wouldn't bother with a further survey that will cost you, as I say, I would write off the payment for the first work in your mind, but go after them in the courts. IMHO the photos + the opportunity to rectify + the other roofers report should be enough to win, but nothing is certain. If you win, treat it as a bonus. This sort of situation can grind you down - don't let it!.

We didn't bother with small claims - just sent "the boys round". In your case you do need to win in court first because the quality of the work is subjective, it isn't just a debt.

Just read "no invoice" - this could give you additional leverage. I would try once more to get a refund, but this time I would suggest that if he refuses, he will most likely find himself reported to HMRC and VAT - he's obviously trying to fiddle somebody...

I just found out he has an unpaid CCJ for £300 from 2016

Whether you trade with him personally or as a company, as long as he has assets you can get at him. Yes, the court process is long and drawn out, but if you win you can send in the sheriffs who have very strong powers (much more than debt collectors).

£3800.00 was that the cost of supply and fix? If it was all you need is the cost to put it right. Its a small roof and shouldn't cost a lot.

Yes, I started a small claim against Mr Teddy Jones TCI Homes and then we went through mediation, which was just a one hour phone call where the mediator speaks to the claimant and defendant multiple times in turn

We eventually agreed that the defendant was to instruct a different roofer to complete the job by removing the old felt, fixing the dry verge, redo the lead around the chimney and fix any leaks
The new roofer did the lead properly, added new felt where it hadn’t been installed properly, and secured the dry verge, it still doesn’t look straight because the found out the battens were too short (flush with the external wall)
The guys who did these fixes were pretty astonished that they had to fix things that any other roofer would have got right the first time.

Not the ideal outcome, but we didn’t want to go through the stress of a court hearing as the mediator also alluded to the fact that the judge might or might not accept the evaluation from another roofer and we couldn’t find anyone that could do a proper independent evaluation.
The agreement also required the defendant to provide proper invoice and guarantee but that never happened.

Apologies to hijack thread but didn't want to start a new one. Outwith major issues original poster had with his roof here, he asked about the white marks at bottom of tiles.

I've recently just had new roof fitted and happy with the job however we have the same tiles and also have these white marks appearing. Roof is only 2 weeks old. Is this normal on these types of tiles or should we be looking for replacement? It does seem to be on every tile

It's pretty normal to get some scuffing from movement with in the pallets in transport.
It will fade quickly and you will not even see it

I’m the OP, those white lines on my tiles were gone after a few days, so don’t worry about that

In the last couple of months some light moss has suddenly appered
They told me they were antifungal tiles, but after all the lies they’ve thrown at me who knows?

Are these concrete interlocking tiles? Do you remember the brand?
