I'd leave it to common sense. Trying to legislate this stuff is a pointless waste of time and effort for no reason.
Following this sort of logic can end up forcing Women who are transitioning to Men, so fully bearded and looking like men, to use women's toilets. Just silly, no one is happy.
Plus, where do you get communal showers anymore? At the moment it's a completely hypothetical question as you can't bloody use them.

But it's a great example of just how much boring crap you have to go through to have rules that can be implemented and just how unsatisfactory they are to everyone.
