Combination Boiler sited directly over bath in rented property

These 2 photographs - one full on and the other of the base) show an unregistered (checked with Gas Safe) combi' boiler installation in a rental property which, from what I know, as a non-expert, of gas and electrical safety regulations is illegally sited in bathroom Zone 1 (only 640mm from top of bath to base of boiler). Leaving aside its unregistered status, which is bad enough but perhaps not surprising, I assume it constitutes an immediate danger to life and should be deemed so accordingly at the next Landlord's Gas Safety Inspection which is due imminently - is my thinking correct? For obvious reasons - fear of death - the bath is not being used until this matter is resolved.

My understanding of the regs for gas boilers (as an old sod I may well be out of date) is that no one should be able to touch an electrical control standing in the bath .
 
It is located in Zone 1 , it should be in Zone 3 and if you look at the top right hand side of tha boiler that is the fused spur, it cant be inside the bathroom , it has to be outside
 
Thank you Ian, particularly for pointing out the fused spur which I had missed. I was aware of the requirement for it to be located outside of the bathroom and had searched for it to no avail - I hadn't thought the installer could be so negligent as to put it next to the boiler in Zone 1!

Is it possible that the boiler was installed before the room was made into a bathroom? not that it makes any difference it is still wrong now
 
Many modern Worcesters seem to be rated at IPX4D (but downgraded if mechanical clocks are fitted) so can be fitted into Zone 1 however scary that seems.
I would certainly not trust kids or some of my customers not to soak the boiler and Worcesters are completely open at the bottom for steam/moisture to enter.
Not sure about the socket, or RCD protection requirements too..post on the electricians forum.

If the fused spur is above 2200mm from the floor then it’s ok as it is classed as outside zones
