Bought an item on eBay. Described as "Used. Not a mark on the item."

There are scratches on the back of the item and two corners are badly worn.

I bid on the item as described.

Have explained to the seller I am unhappy that it is not as described and that I wouldn't have bid so highly if I had been made aware of its true condition, but all he has done is apologise several times.

Would you send it back "not as described"?

Yes, I would. But I think it being an auction item complicates things. If I had known the true condition, I would have bid less for it. But the seller may not be happy knocking some off as we would have to agree how much to deduct and he may just want to have it back and enter it into another auction.

I know some people use NAD unfairly when they want to send something back without paying postage, but this is not the case. I have sent photos to the seller and he has agreed there are marks on the corners, but thought they would "rub off".
 
Begs the question why they didnt rub the marks off then. Auction or not the seller must give an honest desciption, continue to talk and if no agreement can be reached launch the NAD, ebay will then look into the complant and the messages between both parties so the fact they have apologised will go against them.

If you send it back NAD, then eBay provide a return label. Is that tracked?
 
Is the item what you want, and would you be prepared to keep it if they knocked money off? They would lose out on 2 lots of postage (they pay for you to send it back and reimburse what you paid them to send it), so it may be an idea to ask for some money off, unless you really don't want to keep it.

As I said, yes but I'm not sure if they would be happy with that. First, how do you decide how much to knock off and second they may just want to have it back to re-auction it.
