I've never understood that definition. Why would anyone call an arbitrary point some way up the roof slope away from the fascia/soffit "the eaves" when most people understand the eaves to be at the base of the roof slope encompassing the soffit and fascia?

Could you extend the depth of the soffit by lengthening the rafter feet under PD Class B? I hope so as that is a future project I'm looking at.

No that's the definition for measuring roof height

Here is the one for dormers

"The measurement of 0.2 metres should be made along the original roof slope from the outermost edge of the eaves (the edge of the tiles or slates) to the edge of the enlargement."

So you'd measure by putting a level vertically abutting the bottom (gutter) tile and measure back to the face of the dormer - correct?
 
I'd forgotten they have 2 different definitions for "eaves". Where do they find the idiots to write this nonsense?

Agreeing with Ian above, I would have the builder add a false eaves now, while you've got him. Whether in accordance with PD rules or not (it probably is?) if this turns into a problem you will have to come up with something and that seems like the most reasonable solution. I also think it would improve the look. If the problem arises in 2 years, the chances of getting this bloke back will be pretty slim.
 
False eaves - shpeaves!

The planning bods are more interested that the facades of the proposed dormer and the existing walls below are not in line, regardless how big your eaves are.
