Hi there,

So I’m having my roof re-tiled, the roofer booked a scaffolder who came for a day and did half the job and then vanished. Three weeks ago. For a while they kept saying they would come ‘tomorrow’ but didn’t. They are no longer answering calls or messages from my roofer, who has now got as far as he can without the other half of the scaffolding.

I haven’t talked to them myself yet. Am about to try, but don’t see how I can get any further with them than the roofer has done.

Suggestions for how to deal with this? Roof needs to be finished!

Thanks.

Give them notice to remove their scaffolding, otherwise you'll have it removed at their expense and replaced with a more reliable provider.

Phone them and tell them as they've only done half a job and they haven't been answering calls you've sold the scaffolding...

See how quick they turn up then ...

Legally speaking, the contract is between the roofer and the scaffolder, as the roofer engaged the services of the scaffolder.

Yes, although legally speaking I guess they have left a load of unsafe and presumably uninspected scaffolding at my house ...

Right.

Yeah, he needs to issue an ultimatum to the scaffolder and if the scaffolder refuses to complete the scaff, then he has broken his contract with the roofer.

I would dismantle the scaffold and get another scaffolder to erect what's needed and crack on with the job.

There may be a reason though why the scaffolder is refusing to return.
Could it be that the roofer owes them money?

Can you speak to the scaffolding company to find out what’s what? Perhaps don’t give the roofer any up-front money or is it too late for that?

Years ago when I was duty officer onboard ship alongside, any scaffold erected to the masts had to have a 'Certified Scafftag' attached to show it had been certified safe before use.
Does it still apply?

I've never asked for one, been asked for one or been on any domestic job where one has been requested by any 'authority'.

By accepting the structure, would you be responsible if a kid injured themselves on it?
