Are there any restrictions on roof water being diverted into a soakaway.This would be on a new build situation.

I beleive that what you propose is what you are supposed to do
 
When I did my extension the soakaway has to be 3m away from the building, not sure if it's the same rule as today

building control actively encourage storm water soakaways.

Soakaways have to be a minimum 5m from all buildings and roads and 2.5m from the boundary. The size and number of soakaways will depend on the area being drained,ie. the roof and any hardstanding. You need enough land for the soakaways to cover the amount of area you're draining.
You may have to do a percolation test to see how well the soakaway will work. Basically it's hole filled with water and timed to see how long it takes to drain. There's a formula for this test but that's getting a bit involved, let the architect do the specifications, most BCOs will accept this.
 
Here in Scotland the soakaway usually has to be a minimum of 5m from a boundary as well as 5m from a building. Check with local building/ planning control officer. Check also to find out if there is a seperate system outwith the boundary that your rainwater/surface water can be connected into.
 
The restrictions are that the soakaway must be properly sized and designed to drain the water - not just a hole in the ground of random size and filled with broken bricks.

Some locations and soils are lot suitable for soakaways.

The concern with your proposal of 'diverting' roof water to an existing soakaway, would be that the soakaway can not deal with this extra water
