Our neighbour recently laid a porcelain patio. The old patio was slabs on sand so water used to drain away. Obviously the new patio isn’t permeable and now surface water runs off the patio into our garden and it’s flooding. I’ve looked, there’s no drains installed and the patio fall is angled to drain into our garden. Surely this isn’t allowed as the slope isn’t natural it’s man made. I’ve raised it with them and they ignored me. Help!

I would suggest that you get a drainage/garden landscape layout expert in to give you their opinion if its correct then send a copy to your neighbour . its the up to your neighbour what they do about it. inform your House insurance company that this is damaging your property
Sounds like this could end up as a neighbour legal matter unfortunately .

If all other avenues have been exhausted and the neighbours are determined to be arzes, I would be inclined to cement a line of blocks, etc along the boundary, to redirect the water back onto neighbour's property. Far cheaper than getting legal.

Thanks everyone. Yes I’m thinking of building a little wall to divert water back… Although the patio they’ve built probably won’t last long - the porcelain has been laid directly on the old sand sub-base with only a very thin layer of mortar. Won’t take long for it shift about and crack allowing water to drain through again

At which point be prepared for them to blame you because you built that wall....

It would be a statutory nuisance. He has no right to discharge water on to your land. Unfortunately you have no right to block any natural discharge so the flood wall needs to be carefully installed.

The fall of the patio is man made. Natural ground in the area is permeable the patio surface is not. Probably an easy argument.

I feel that with things like this, it's best to object when neighbours are building something and even involve the council if they don't give you a damn. Once building work's completed, no one shows interest and it becomes a civil matter in a court.

What part of laying a patio is part of what remit of a local authority?

Statutory nuisance.
Thats after the event - Android was talking about getting the coucil involved before/during the laying of the patio.

Planning.
