leaking oil pipe in shared passage

we have a walk way through our house or on one end which belongs to us
the neighbour has run a oil pipe through our walk way fixing it to wall then in to his house
we have a bed room above this walk way
there is no fire valve fitted

the other day there was a leak which we could smell through out our house

is this safe?

Would this affect our insurance?

You need to check your deeds to see if he has crossed your boundary line, if he has, have a friendly word with him and ask him to remove any encroachment.
