Neighbours boiler flue 10cm from our garden

Our neighbours have installed the flue for their combi about 10cm from the edge of our garden, so whenever it runs you can smell it in our (small) garden. I thought you had to be more than 60cm from the boundary? Or does height also mean you are OK - it's 240cm from ground.
The property is being done up by a developer who has already breached planning twice sneaking in a bigger window here and a higher wall (so ceiling) there. So wouldn't put it past them to not follow regs, but wanted to check with experts here first..

I believe the minimum is 30cm. That one seems to be one and a half bricks from the edge of the wall which is a bit more than 30cm, so may be ok depending on where the boundary is.

The gas regs distance to boundary is one thing. If the flue gases are causing a nuisance, then a complaint to the council's environmental health team can get some action if the flue is deemed to be a problem.

Or ask them to fit a plume kit.

Bigger window- unlikely planners will get excited. Higher wall- different kettle of fish. Have you emailed your local planning bunch pointing out the discrepancies between what was applied for and what has been built? If not then I guarantee nothing will be done about it. If you do then action may be taken- depends on a few things though
