Son of claimant to stay behind in UK as father flown to Rwanda
The son of the third asylum seeker who had his appeal to be removed from tonight’s flight to Rwanda rejected will stay in the UK while his father is flown to the African country.
Sonali Naik QC, for the third claimant, said: “This claimant left his home country with his adult son who lives in the UK and who is an asylum seeker who is not subject to the Rwanda policy, so, as it stands, the claimant will be removed to Rwanda and the son left behind.”
Telling the court the Iranian man had been abused while in Greece before coming to the UK, she added: “This is a father and son who are both asylum seekers and have been travelling together.”
Benjamin Seifert, for the Home Office, said the son was not an adult-dependent relative and that if his father needed to be returned, it would be done within a “reasonable time”.
Mr Justice Swift said the man had been through an “arduous” journey with his son between Iran, Greece, Germany, France, and then the UK.
“I accept that separation following that journey will be a matter of distress,” he said.
However, the judge refused the application, finding it did not over-ride the public interest in deporting the man.
