As for protection, this has tripped out a couple of times in the past but equally the fuse wire (5amp lights) has also popped a couple of times without this tripping.

Hi, I don't think the element is submerged at any time, try filling the base with a jug of water and you may see that the level will reach the overflow (guntower) before it gets as high as the element, i think its the movement of water circulated by the arms/jets that keeps the element wet...
