I’ve instructed my planning consultant to apply for a lawful development certificate for existing use today and he’s given me quite a puzzling response.
He’s making a point that when an applicant applies for an LDC for existing use only when:
- That the operations which have been carried out...
Hello,
Thread update on this and I’m pulling my hair out and need some help.
Summary:
- I received letters and communications from the council saying that in their view the deck requires planning permission and is open to enforcement action because any deck over 30cm in height at any point...
I did, followed the advice given here explaining why I think it’s PD and this was their response a week later.
I’m not sure what to do regarding when to sell this house. I sometimes think it would be simpler just to rip it out and sell quickly but I don’t think I should have too as it’s PD...
Update:
I emailed the council to explain how the height of the deck is less than 30cm at the point where the sloping site is adjacent and received this response.
“I can advise that if the height of the raised platform (decking) exceeds 30cm above the original ground level at any point it is...
Other QQ - I had intended to sell this house ASAP
Does getting letters like this from the council effect that?
Should I resolve this then put it on the market or try to sell first but tell solicitors we’ve had letters from the council about the deck and planning permission but that it PD and...
QQ - do the same permitted development rules apply for height being under 30cm on land adjacent to the deck apply if you have a balcony section? As shown in my diagram, the deck steps down into a balcony section facing towards the house.
Hi all,
I share a boundary fence on my front drive with a neighbour, the fence was built by the previous owner of my property and I’ve been maintaining it but it has rotted beyond repair. I intend to replace it at my own expense as I know my neighbour will not contribute anything towards it ...
Really appreciate your help everybody.
Will send them a response, I have a strong feeling the council will persist as I have a feeling the person who reported it knows people who work there so I am fully expecting some shenanigans on their part like on the other thread!
At what point should I...
I couldn’t quite believe I was having to tell him about said rules..in his report tbf he did actually find more specifics and agree with me but doesn’t give me much hope in dealing with the council.
Should I just email the planning officer explaining how it’s permitted development cause of the...
Not yet, just got the initial letter asking me to submit a retrospective planning permission application.
I’ve had advice to apply for a permitted development certificate in the meantime or to tell the council the deck they’re asking about is permitted anyway and leave it that. Then I guess...
Hi all,
I’m in a bit of a pickle with the council as I’ve had a planning enforcement letter come through about a raised deck I had installed a few years ago. I believe the deck structure itself would get a permitted development certificate due to the fact that it’s on a slope and at the grounds...
Thanks - just for reference as well the decking js at the back of the garden and not adjoined to the house. Does that change the slope - 30cm rule at all?
I spoke to a planning advisor earlier who wasn’t aware of such a rule
Hi all,
Someone has reported a raised deck I had installed 2.5 years ago to the council and they’ve sent me a letter saying:
“It has been bought to my attention that a raised platform has recently been constructed at the rear of your property. These works require planning permission. This is...
