Operating business from home

Hi all, I'm not sure where best to post this but here goes. We have covenants on our houses not to operate businesses from home and the new neighbour is in the scrap metal business. He parks his truck on the drive every night loaded with scrap metal and sometimes it's there all day. Is there a way to stop this by means other than trying to enforce a covenant which would incur solicitors fees? Thank you!

Might be difficult. He's not actually operating a business from his home no more than say, a plumber or an electrician who takes the van home for the night.

You would first have to prove that you are the intended beneficiary of any covenant. Many covenants and easements were slapped on to deeds before cut and paste was even invented and have become standard, and yet they cannot be enforced.

Your chances are also slim in proving that this action is deemed to be running a business.

You may have a better chance under a private nuisance claim, but still difficult and just as costly.
 
Thanks everyone! Problem solved. The neighbour is not licenced to operate according to the local authority and the beneficiary of the covenant has also written to him to inform him of another covenant, no commercial vehicles to be parked at the property. The vehicle has gone. @Freddymercurystwin, we do live in the middle of nowhere
