Boundary Issues

My garden is bounded on 3 sides by a fence, that doesn't offer much privacy - I would like a taller one put up so we get that privacy. Trouble is I am only responsible for 2 sides of the boundary, my neighbours landlord being responsible for the final 3rd side. I could offer to pay for it all, but dont want to! Is it fair and normal to ask the landlord to pay for his 3rd, or will I be whistling in the wind...!?

I would be of the opinion, you want it, you pay for it

I would be of the opinion, you want it, you pay for it

I could use leverage if I wanted to fall out with my neighbours...the fence isn't the best and their dog keeps straying onto my garden... ;)
 
in general his only requirement are to maintain the boundery as specified in the deeds or other legal document that could be from nothing to a 6ft fence
more usualy about 4ft but never usualy more than 6ft6" or 2m from ground level

there is nothing i belive stopping you putting your own fence fully on your side off the boundery
but check as you may under certain circumstances finnish up adopting responsibility for the boundary

but as breezer said ask ;)

...and, if you do put your own up, make sure there won't be a problem with your neighbour getting access to his fence for maintenance - I have been to some gardens where the other side has some rights or other to get access for painting/hedge-trimming etc.
 
you also have to be carful when you put up a fence on your side, as some people take their own tatty one down and then acquire a bit of your garden
 
Good point thermo ...and they would`ve got away with it under the law of Adverse Posession BUT the law`s been changed recently :oops: Before the change you had to enter the(your) land once every Michlemass and drive 3 stakes into the ground and recite Latin verse to ensure you kept your entitlement ;) That`s 3 stakes per rood
 
yep and you try proving it all with the stte of many deeds. It will cost you an arm and a leg and take a month of sundays to get it back if you can prove it!
