Building a garage with a questionable party wall

Hi,
My next door neighbour is very boundary protective, So I'm ready for a dispute.
Anyway, here's photos of the party wall and their garage:

If I want to use the 1/2 of the wall that is within my boundary, can I use it as my garage wall?

Use it for what?

Have you actually defined the boundary and ownership of the wall?

The second image is not clear how the building wall sits on the boundary wall. Is it like the first?
 
That wall doesn't look good enough to build from. I would be inclined to come in from the boundary a smidgen and build something totally separate. Avoids issues with overhang/gutters etc as well.

They own the wall.

The garage uses the full 9inches of the wall, which is the same wall in the other image.

That wall doesn't look good enough to build from. I would be inclined to come in from the boundary a smidgen and build something totally separate. Avoids issues with overhang/gutters etc as well.
Hi Mr R,
Coming in from the boundary, which to me is 1/2 way into the wall. = 4"
Then their over hanging roof = 5"
Then my 9inch wall = 9"
=18 Inches lost instead of what you see, and space is limited, because of turning into a right angle.

Good idea but throws up another headache - undermining (angle of repose), issues. Unless said wall has a nice deep foundation, building close to it can cause issues.
