A French couple who named there baby "jihad" will have to wait for the French courts to decide whether the name is allowed

Officials in Toulouse referred the case to Frances chief prosecuter who will have to decide if the name is legal.

While France does not explicitly restrict parents name choices for children , the courts can rule if it is thought a name could harm the childs interests.

In 2015 a French court prevented a couple from naming there baby daughter "Nutella" ruling that it would make her the subject of ridicule.

In Nimes in 2013 A mother was fined by the French courts when she sent her 4 year old son , called "jihad" to school wearing a jumper with his name Jihad , born September 2011 on the back of the jumper and the wording "I am a bomb" on the front.
