Where do I stand if it fails, can I still drive it until the currant mot runs out? (Should say tested not rested)

Not anymore you cant.

Depends if it fails on anything in the "Dangerous" category. If not, then you're fine to drive it for as long as the old MOT is stil lvalid:

"Driving a vehicle that’s failed
You can take your vehicle away if:

  • your current MOT certificate is still valid
  • no ‘dangerous’ problems were listed in the MOT
Otherwise, you’ll need to get it repaired before you can drive."

That's why I avoid the garages which also sell you repairs.
They have no shame in failing for something dangerous and tell you that if you drive the car out they ought to call the police.
"But we can repair this for you, mister"
And a £35 MOT all of a sudden becomes more expensive than the car itself.
I think I've already told about the many scams I came across.
