Have a good look at the Neighbours garden for any obvious issues (because he'll obviously be liable for part of the work if there is) and be very careful when you dig wider foundations on his side, in case it the bank collapses. Obviously, if you were to take down part of his garden, you have to make sure you leave it on his side, to be able to back fill it afterwards.
