We had a leak.................

1- As an expert witness and having gone to court more times then I can count I found most of the time when a flooding condition happens one should contact their insurance company and give them all the facts THEN THEY go after the guilty party's insurance company of after the guilty party.

2- A Stand pipe is very common as it is a nothing more then a pipe to accept the discharge from a washing machine as many kitchen sinks do not have the L X W X D to hold the volume of water during the drainage cycle.

This stand pipe all though trapped does enter the same drain line as the kitchen sink in most cases and if the kitchen line is not water jetted periodically the soap scum (film) and grease deposits serverly restrict the flow and will cause waste water to seek its own level depending if the stand pipe is higher then the kitchen sink then the muck will flow out of the kitchen sink and mess everything up.

If the stand pipe is lower then the kitchen sink (very rare) then water will spew out of the stand pipe.

Either way the apartment dweller should be held totally responsible and if they have an ounce of brains they should have either renters insurance or home owners insurance

Now if you get a semi decent licensed plumber or drain guy they can document the problem THEN you get a low life HUNGRY lawyer and a doctor possibly an enviormental specialist like a MASTER PLUMBER to swear the following

The contaminated water because of the grease and the flooding condition entered your walls and ceilings and now with the growth of mold you found you cannot breathe properly and the headaches are severe plus the insomnia because you hear critters (vermin) moving inside the walls devouring the grease and food particles.

A decent expert witness can get you not only a place to stay while your apartment (flat) is brought back to human standards of living and all the pain and suffering you were subjected to by the inconsiderate low lifes above you.

Considering your in England I do not think you have any more rights THUS you should contact a plumber BEFORE asking any lawyers if you have a case as the British lawyers sold out its citizens as a mans home is no longer his castle according to softus.

fourtunately build standards here are for houses not leanto sheds
ie generally we dont do wood and stud build.
so no tom and jerry cavities for vermin, mainly dual brick or and thermolite contstruction. ;)
 
WDIK, long time since I saw a house built with good old brick (both leaves). I do not know what construction methods are used south of the border, but many homes in Scotland are built quicker than the time it takes to lay the foundation.

I wonder how some posters would react to PIPDL

The reality of vehicle insurance is that for all damage only claims virtually all insurers seem to have knock for knock agreements with virtually all other insurers.

They say it keeps down costs! That must be true.

However, one hears of people losing out in respect of loss of NCB and excess as a result of these agreements.

Since Direct line have so many clients, if you are insured with them you have a good chance of any accident being with someone else insured with them!

On household insurance, I regularly come across damage which has resulted from faulty work. The reality is that insurers never seem to chase those responsible. Again because the costs of doing so are not justified.

One I saw last year had had a small leak dripping onto the wood block floor in a large open plan kitchen lounge. The actual damage was only about 4m² but the whole floor was replaced plus the kitchen which was on top of part of the floor. Total cost was about £20k whereas just doing the 4m² would have been perhaps £300 ! Again no one chased the owner of the flat above where the leak originated.

A couple of years later another leak from the same flat did more damage but I dont know how that was repaired. The cause of that time was a solder ring fitting which did not have adequate clearance and every time the floor board was walked on the joint was stressed and after about 15 years started leaking.

Abut your statement about hating the place (NY) I really cannot blame you, no one in their right mind would want to live here BUT seeing how we escaped from England I doubt very seriously they would accept the likes of me to return and say all is forgiven.. Now all I have to do is learn how to hit the accept part

THANK GOD ( can I say God on here) that in MY FREE COUNTRY if a bloke, person or something in between "HATES SEEING THIS POST" in a FREEDOM loving country they have choices

1- Ignore the posting they have a distain for

2- Move on and start another post IF they are in the land of the FREE

3- Say nothing and go about their business

4-Or say nothing and let people think they left to meet their maker and after a few years someone may ask

"What happened to that bloke (mate) who once posted the following

"I'm sick of the sight of this post! Can we have it closed please"

Then you can return as a hero stating I HATED THE POSTING so you boycotted it

Glad I am in a country that allows me to ignore postings or add to them or just read and not say a word pro or con..

See what happens when the government takes your freedoms away you have to BEG to have a posting closed WHAT A TERRIBLE society you live in that you cannot make a choice yourself . We have very old buildings here in NY (no where as old as England of course) but many roofs are made of wood and the interior walls are wire lath and wood and plaster besides tile.

Because the laws forbid the execution of lawyers this menace of society have found a new nitchie to sue over besides slips and falls and asbestos and bad medical practices they now found MOLD a great nitch to sue over.

Many states now have insurance companies that refuse to cover plumbers for mold insurance as people start coughing, sneezing, break out in a rash and the plumber is held responsible or the roofer or anyone who has contact with water like a tile man doing a shower.

So a person living in an appartment causes a leak and then mold starts growing besides mold coming out of the wood work so do lawyers along with other vermin .

Insurance companies try to ignore it when possible unless they are actusally confronted by the victim of the problem such as the appartment dweller below.

A leak causing any type of damage means someone has to be compensated

Could it be wood is to expensive to secure in your country?

Also everyone knows the BEST carpenters come from Ireland as NYC was built by the Irish craftmen and the Chinese built the railroads
