Hi all. I'm looking for some advice. I live on a David Wilson Homes development built around 2008. As part of the development a pathway was put in to link it to the adjacent hospital. Almost immediately it caused many problems, mainly parking and smokers from the hospital. It was closed off by the council because of this. Turns out the road/pathway are not yet adopted and the council shouldn't have done this and it has been reopened. We are told now that it cannot be closed due to its existence on the development plans which were agreed upon by all parties, even though they all agree it should be closed.

Is there a procedure in place to be able to alter plans of this type? Surely these things can't be set in stone. I'm trying to find out if the council are right or whether it would just be too much hard work for them.

Thanks in advance.

Matt

Great site by the way, can't praise it enough.

Well the plans (including the footpath) were approved and then the development built in 2008. There isn't much, if anything you can do now... some six years later. This would have been better picked up upon purchase of the property, but even then... I'm not sure how or if you could challenge it at that time as the plans and development had already been approved.

Footpaths can be closed through various processes, it may be the ownership which is confusing things.

If it's a footpath, how do people get cars onto it to park them?

And why do you need to close a footpath because of smokers?

I imagine its s problem of people parking on the roads of the estate and walking to work next door.
