asbestolux under floors

Hi

During recent building works on my property asbestolux was found under the floorboards in the landing area. It was being used to "pack" the joists running across the landing. The builder told me it should not have been used in such a way. Can anyone tell me if this material could be dangerous used in this manner? The house is only 4 years old and I am considering whether to take action against the original builders, but want to firstly get my facts straight.
