Tony are you suggesting that if the neighbour ignores a request to move their boiler, the OP can go ahead and build the extension regardless, even if it causes a dangerous situation???

Within the last year there was a pensioner charged with endangering life or something similar purely for putting a board up close to a boiler to stop nuisance plume across his windows .
So those that think someone could build an extension right upto a flue without consequence are IMHO talking sh#te
 
Its up to the neighbour to move their boiler so they can continue to enjoy its safe operation.

The OP can build his extension after giving the neighbour reasonable notice of the proposed work. If the neighbour thought that there was any reason to stop the works then he could then apply to the courts ( but unlikely to succeed in my view although they might grant a stay of execution ).

Also the boundary rules only came in, in 2002 and there was nothing before that .

I can't find any reference to anything like this on our subscriptios to case reports.

Give us a clue and I'll see what the facts of that case were
 
Has anyone from the council been round such as building inspectors or planning office when you submitted your plan ? That would have been spotted by them surely

woody it was in the Daily Record initially as it happened in scotland but the nationals picked it up a few days later, Was in papers for a few days
