We are considering buying a terraced house that has a very steep sloping rear garden. It is similar to the picture for number 2 "sloping natural ground level" in the following link:

If we built an outbuilding at the bottom of the garden by digging out a level section at the bottom of the garden (like the after picture in the link, but with a maximum height of 2.5m), the roof of the building would be below the level of the highest point of the garden. Would we be able to put handrails around the roof of the building and use it as an extension of the remaining garden without planning permission. I know planning permission is now required for raised decking. Would this fall into the same category?
