The Swindon Advertiser linked on page 1 says;

"..............the 60-year-old was not being accused of causing the blast in Beechcroft Road in April 2004."



"Following investigations by the defence it was shown there may have been other reasons for the accumulation of gas which had leaked out, causing the explosion."

It seems there was a gas explosion, HSE investigate, find unregistered gas work has been done next door, but no evidence as to the cause of the leak. Hence no prosecution for actually causing the blast.

I'd think the objection to using a former water pipe would be the amount of limescale and dirt that would collect in the pipe over the years. There's a considerable amount of muck in mains water, apparently.

Read the story from the Swindon Advertiser and it explains about re-using water pipe for gas.

"With regards to the pipe being reused, he said the regulation was in place to stop dirt getting into the burners or flue, but the boiler being installed was fitted with a filter.

As such the court was told that the offence was almost a technical breach' of the regulations"
 
For anyone new to the trade reading this, it should be pointed out that a criminal conviction was not sought by the CPS for causing the explosion because the prosecution must prove the case beyond all reasonable doubt to secure a conviction. Inadequate evidence, hence no case.

However, the householder's insurance company will want to recover their costs and may pursue the convicted man, and the estate of his deceased partner (can you sue a dead man?), in the civil courts. In the civil courts, the judgement is based on the balance of probabilities, so this might well result in a judgement against the defendants. They won't have been insured to work on gas, so I think they may be handing over their houses, cars, savings, etc.. The fine is the least of his concerns.
