Thanks for reply. By the looks of it weeds started growing in the type 1 above the membrane as they are of the the more grassy variety. I didn't know that Type 1 can accommodate weeds, but that makes sense. Shingles is the way forward. Thanks again.

Thank you for your comments. Better look into more detail on what "structure" actually entails and whether it includes the retaining wall, which only is as high as our ground differential. I don't like assumptions at the best of time and maybe that's where the grey area is for us as the depth...
