Allowing NHBC to act as building control, then to be the warranty provider is also a major conflict of interest.
The New Homes Ombudsman looks to address customer issues with developers and NHBC.
But is only valid for reservations made after 4th Oct 2022 - I fall just outside of that.
(y) I won't 'go legal' until I've had my own surveys done and presented those to NHBC ...
So far during this process Bellway and NHBC want a cost neutral repair, so they will put blame on the original bricklayers and instruct them to rectify for gratis. Not the solution I want ...
I can see that argument ... I think its possible to escalate things quickly through the legal process with the right expert witnesses, structural engineers etc ...
I have spoken to someone on another development with a similar mortar issue, who is taking a class action with 14 of his neighbours
Buying off plan you 'trust' the builder would build to spec, but they decided to go 'off piste' and slap it up with a 1:11 mix.
Bellway expect me to shut up and...
2x samples were taken, back and front just above DPC ...
Yes I do have legal cover, but their are only a very few solicitors who specialise in this sort of work, and I'd rather use one of them and reclaim the costs if they are confident on getting a better outcome with Bellway.
Even to get...
Thanks ... racking out that deep in perps must be tricky, can't get a disc in them that deep without cutting the bricks?
I've heard of one other development some houses had this done ... in 1.85m lengths leaving 45cm gap 'pillars' between rake outs?
Trouble is most repointing brickies don't...
Thanks ...
Yes the lab result is very reliable accredited company, one of only two recognised in the UK for mortar testing.
It looks like to get this resolved it will mean tens of thousands in legal bills, I know this from speaking to someone on another development with mortar issues ... BUT...
Thanks for the info and the link.
Its a big decision whether to battle it through the legal process.
I've heard the developers fight these cases hard and throw a lot of legal resources at them.
Although one would like to think with such a weak mortar mix they haven't got a leg to stand on.
My experience of NHBC has not been good, they are in effect an insurance company and their 'inspectors' are just lost adjustors trying to find the cheapest easiest way out.
Plus its was their shoddy building inspectors that signed off the build.
NHBC are funded by the big builders and don't...
Thanks, sounds like major works I guess not many brickies would undertake?
...the house would be unhabitable during this process with windows/doors removed?
That sounds unsightly fixing through the brick faces?
It's blocks - cavity - bricks
Could the external brick walls could be demolished and rebuilt, as non structural?
Thanks for that ...
It was silo supplied by CPI mortars
What about wall ties into soft mortar, will they do their job over years?
It seems the NHBC and BS guidelines aren't worth the paper they're written on.
As soon as I raise this higher though a solicitor and possibly courts then my house...
