Retrospective Planning Permission for Raised Decking

Thinking about what they actually said, they are trying to say that because the gradient of the ground is so steep that even though we are within 30cm at the highest point, the context of the land (the gradient) means that the reference point should not be the highest point. I think they are...

Retrospective Planning Permission for Raised Decking

After no response via e-mail we rang the council this morning and we have had a very different perspective laid out over the phone. First of all the decking. They agree that the "structure" is within permitted development of the height restrictions (Thanks you very much) BUT (and there is always...

Retrospective Planning Permission for Raised Decking

Ok, thank you for all your support. We wrote back to the planning officer last night to say that we feel that it is within permitted development due to the height being level with the highest adjacent ground. So hopefully we'll see what they say. We've had no communication back yet regarding...

Retrospective Planning Permission for Raised Decking

Ok i didn't see that last comment about reducing it to 30cm of the immediate adjacent ground. Althought that word adjacent is back again and I understand (doing some research) that the criteria for adjacent is again open to interpretation.

Retrospective Planning Permission for Raised Decking

Many thanks. It is interesting that both of the appeals above reference the impact on privicy for the reason to refuse permission, and even more interestingly (if there is such a thing) the second one notes the height at the end of the structure (1M above ground level) but it is not referenced...

Retrospective Planning Permission for Raised Decking

Hindsight is a wonderful think. In response to the other question, the end of the new decking that is connected to the upper garden is level with the natural ground level of the upper garden. Therefore yes the decking starts off at natural ground level.

Retrospective Planning Permission for Raised Decking

Are there rules around size of decking? I know there are issues with permiable surfaces at the front of houses but i do not think we have a surface water issue. The garden is quite large and this is a small % of the overall size of the garden (<50%). Its also not attached to the house so it is...

Retrospective Planning Permission for Raised Decking

The natural ground level drops down steeply 10ft from the "upper garden" to the "lower garden". We have built 2m of decking straight out from the upper garden as a balcony on stilts so that it overhangs the lower garden. This is level with the upper garden but by the time you get 2m out the end...

Retrospective Planning Permission for Raised Decking

Thank you all for your responses. I'm beginning to second guess what the issue is now.The patio is at natural height, it's just that there is a large drop off down to the lower part of the garden which we have extended the decking over to form a balcony. The enforcement order states the...

Retrospective Planning Permission for Raised Decking

Hi all, wasn't sure to raise a new thread or comment on an old one but as the last time this topic was covered was about 3 years ago I thought I’d go for a new thread. I need some advise regarding applying for retrospective planning permission. To the rear of our property we have two areas of...
