Deemed discharge, Appeal, what are the processes?

You said you have waited 3 years+ for the discharge of conditions to be sorted? Deemed discharge appeals can only be submitted regarding applications that have been submitted on or after April 2015. You also can't use them for certain types of condition. I am confused about the Lawful...

Starting my Build without Condition Approval - Risk?

It's your risk. You could crack on and they could approve it and have no worries. Should something be wrong with the license / info to the Council though you could be in hot water. The only thing I would suggest is the condition only relates to the roof space / loft and demolition. If you do...

Deemed discharge, Appeal, what are the processes?

Its really difficult to read in a huge block and not know anything about the applications... At a guess: 1. You have had all the conditions signed off except 1? Why is that one not signed off? I am struggling to see how you could apply for a certificate of lawfulness in this case. You can...

Starting my Build without Condition Approval - Risk?

Depends on the wording of the condition, but I assume it's a pre-commencement condition. If so then technically it can validate your permission. In reality if the information complies with what they were after in the condition then they are unlikely to quash the permission. It's to secure...

Attaching a detached garage - PD clarity

Yeah, we're just being picky over ambiguous legislation! Generally nothing for you to worry about / you should be fine

Attaching a detached garage - PD clarity

No problems with any of the original meanings etc. It's the nature of the detached original outbuilding, once amended and how it relates to the original house then. For me, if you have an original detached outbuilding and you make it say, wider under pd, you still have an outbuilding. But...

Attaching a detached garage - PD clarity

I am not entirely sure - and I certainly can't quote a specific case. My view would be if you have something original (or not) that's detached and you attach it to the main dwelling via an extension, then the whole of the development extends from the main dwellinghouse and should be considered...

New window on front of house

No planning permission unless you are in an Article 4 area restricting changes, or it's a listed building. Assuming that it's a flat velux window that's similar material to the existing house. Rear windows don't have to be obscured, only side facing windows.

Attaching a detached garage - PD clarity

I did pretty much answer this on the other thread, but to reiterate: When you attach the extension to a garage, you no longer (in planning legislation terms) have a detached garage.. You have one large extension from the house, in this case both a side and rear extension. Whether or not you...

    Larger rear extension

Yep, see my first paragraph response and the initial advice given. Yep, see my final paragraph response I don't think you can attach to the garage. The garage then becomes an extension to the house, rather than an outbuilding and your 6m extension will then become longer as it will include...

    Larger rear extension

Unfortunately no you can't. The way the permitted development / NCS works is that everything you attach your new rear extension to must conform with permitted development rules. So your existing 3.3m eaves height extension TECHNICALLY, would not be able to be extended from whatsoever under the...

    Unenforcable planning condition ?

Agreed - worth checking. If it is how the OP portrays, it's not reasonable to enforce and now due to the expiration of 10 years it is not lawful to enforce. It was either implemented, in which case the time (10 years) has expired. If it was not enacted, then it would not technically benefit...

    Unenforcable planning condition ?

After 10 years or more (in this case sounds like approx. 18 years have passed since the building of the bungalow?) then any condition has been breached (in this case 3 parking spaces not provided) then the condition is no longer enforceable anyway.

    PD for side windows

Technically, it's the insertion of new windows, so both the new windows would be treated as 'new' windows and have to conform to PD conditions.

Retrospective Planning Permission for Raised Decking

This is rubbish. Firstly if they agree that the decking is permitted development (which I agree with following Tonys view) than that's the end of the matter. It's permitted regardless if it has a detrimental impact or not. Following that (which really should be it) you quote from them saying...

Retrospective Planning Permission for Raised Decking

As Tony says it's the highest part of the ground. As long as your decking (in this instance at the point furthest away from where the photo is taken) is no higher than 300mm then you will be fine. They won't let you know where the boundary is, they will put the onus on you to prove that.

    Difficulty with planning

3m is really ridiculous setback. I have been partly involved in an appeal that was submitted at the end of January 2017 and still no answer yet.

    Is this permitted development?

This would be helpful. ^ If you have a semi detached property you can't extend 4m under Permitted Development.

    Changing back to a house

In planning terms, generally, it should be okay. The planning system isn't really interested in loss of revenue. 5 Flats -> 1 dwelling should be fine; you've got less demand on the area, less trips, less parking needed, still a residential use etc etc.

Where to start?! Dormer Window behind bedroom.

There's no permitted development for extensions to extensions. It all falls under the same permitted development rights for the original extension. Just consider whatever your attaching the extension to isn't there - then judge whether or not permission is required for the original extension...
