    Neighbours challenging LDC

The LPA will have withdraw some of the PD rights as it is a conservation area, this can cary by area though so what PD rights have been withdrawn need to be checked.

Do I need to make a planning application?

Think we have wires crossed, I'm talking about butting up to existing outriggers, think you are talking about existing extensions? The rules to stop PD extensions butting up to other extensions is to stop people simply building one extension, then the next, and then another, etc.

Do I need to make a planning application?

PD extensions are more about changes in size and volume than retention of actual fabric. Sure if you demolish the extensions then put in an application they will count it as 6m, but assuming that wont happen it would count as changes to the existing fabric plus an extension. Whether you rebuilt...

Do I need to make a planning application?

Which bit of the PD rules are you referring to? If the outrigger is original then you can certainly butt up / connect to the outrigger, you just cant build more than 50% width of the whole house. The restriction and the gap work around to which I think you are referring to is when there is a...

Do I need to make a planning application?

That is correct if the existing outrigger is original or built pre 1948, otherwise the existing outrigger must be included in part of the PD assessment. The existong outrigger doesn't look original based on plan form so you need to determine when it was built.

Do I need to make a planning application?

You can still do a rear extension under PD it just can't fully "fill" the gap and is restricted in width.

PP for BP replacement drive and creation of NEW hardstanding?

The "pavement or verge" is defined by where the "highway" is. From what I can tell there is no legal definition of a highway but common law has established a "highway" to be where the public have the right to pass, so ownership of the road is not what defines this, but whether there is a right...

PP for BP replacement drive and creation of NEW hardstanding?

Correct re the indemnity policy. But there's no need to ask for retrospective permission... the point of the indemnity is that you do nothing and then if the council raise as an issue the policy picks up the cost of the mess.

    Shared rainwater downpipe question?

Re reading your original post I think you have no rights to remove. If the downpipe was shared in use it will still be classed as shared, just because it may no longer be needed doesn't stop it being shared. Arguing it is on your land probably isn't enough, as otherwise you could have removed...

    Extension Build is this right?

Cleaning guttering, painting etc. isn't really much of a problem they do have right to access as woody points out, but two walls within inches could cause problems if say leaves built up in the gap, or something died down there, and then both properties will end up with the same issues and same...

    Extension Build is this right?

Your mates eaves, soffit, guttering etc. overhang your neighbours land, and drains across his property... Are you sure the boundary isn't actually further across say 1/2 a meter from the wall? If it does in fact overhang the neighbours property it is possibly trespass by your mate and the...

Fire doors, fire and smoke seal required on the side?

Generally all the doors in the hallway should be FD30, not just the loft room, this only seems to relate to one door - have all the other doors been inspected. The builder may be useless, but the inspector should be picking this up and sounding the alarm bells not you. That's the point of...

PP for BP replacement drive and creation of NEW hardstanding?

If the road isn't classified/council owned/maintained then I assume it is a private road with communal maintenance cost. In which case I don't think the council can dictate dropped kerbs or alterations as you aren't altering a "highway" (but the private road owner / shared ownership structure...

    Barn Conversion - Planning Required?

As it is existing and connected through an internal door I think it would be best classed as part of the house (rather than an outbuilding which is detached) and therefore similarly classed as a garage, rather than a "barn" even if that was its historic use. This means you won't need planning...

Do I need to make a planning application?

If the house is different the calcs won't apply. So I wouldn't use that builder.

Do I need to make a planning application?

When someone instructs a professional to design a house/extension the normal copyright agreement is that the design ownership remains with the designer, and the client has a license to build it at the defined address. Anyone who uses someone else's designs/drawings without knowing the copyright...

Difficulty achieving required uvalues, can I negotiate lower?

Old solid brick walls breathe and absorb/release moisture. Upgrading them has two trains of thought: Approach 1. Membrane/DPC batten the brick wall, insulate and add a vapour control layer on the warm side of the insulation. This approach assumes the brickwork still has lime mortar (which it...

    Lawful development certificate

It still won't comply. Broadly a roof extension has to be above the original roof, and a rear extension has to be below the roof, and they cannot touch. You cannot have a hybrid as you cannot extend a roof extension backwards beyond the wall below. The top surface of the flat roof to the rear...

    Extension

Many people use LDCs for reassurance as they aren't experts in interpreting PD rules. Of course something like a roof light it pretty basic. But when people start adding side, rear, roof, dormer, rooflights, porches, etc. In one go it can get a bit more technical.

    Extension

Many of the hybrid approaches don't legally work when building in one operation, they are stories based on what blokes in pubs say.
